1. Acceptance of Terms

By accessing or using ActionTree (“the Service”), operated by ActionTree (“we”, “our”, or “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ActionTree is an AI-powered platform that enables businesses to deploy AI receptionists on their websites. The Service includes page creation, AI-powered visitor conversations, lead capture, appointment booking, and integrations with third-party services such as Google Calendar and Stripe.

3. Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to use the Service.
  • One person or entity may not maintain more than one account without our permission.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Distribute spam, malware, or harmful content
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the AI features to generate illegal, harmful, or deceptive content
  • Resell or redistribute the Service without our permission

5. Your Content

You retain ownership of content you create on the platform (page configurations, knowledge bases, branding). By using the Service, you grant us a limited license to host, display, and transmit your content as necessary to operate the Service.

You are solely responsible for the content you publish and the AI instructions you configure. You must ensure your AI receptionist and knowledge bases do not contain content that violates these terms or applicable law.

6. Third-Party Integrations

The Service allows you to connect third-party accounts (e.g., Google). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. You may disconnect integrations at any time from your dashboard.

7. AI-Generated Content

The Service uses AI models to generate conversational responses on your behalf. AI outputs may not always be accurate or appropriate. You are responsible for configuring your AI receptionist appropriately and reviewing its behavior. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, ActionTree shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill. In no event shall our aggregate liability exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violations of these terms or for any other reason with reasonable notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
